Short Term 482 TSS Visa

Employer Requirements

The business seeking to employ you must:

• Be actively and lawfully operating in Australia; OR
• Be actively and lawfully operating overseas and bring the visa applicant to Australia to establish a business operation or fulfill contractual obligations.

Additionally, there must be no adverse information regarding the business’s suitability as an approved sponsor.

Note: Adverse information includes, but is not limited to:

• Violations of Commonwealth, State, or Territory laws related to immigration, industrial relations, or taxation.
• Pending investigations or disciplinary actions.
• Administrative action for possible law violations.
• Insolvency.
• Providing false/misleading information to the Department of Home Affairs (DOHA).

Accreditation

Some businesses may apply for accredited status, allowing for priority processing of TSS nominations. Please contact us to see if your employer qualifies.

Nominated Position Requirements

The position to be filled must:

• Be a genuine, full-time position.
• Be in the sponsor’s business (or that of an associated entity) with a written employment contract (unless exempt).

Note: If the sponsor is overseas, the position must be in the sponsor’s business.

Offer a salary that meets the following criteria:

• At least $70,000 per year (excluding non-monetary benefits).
• At least the Annual Market Salary Rate (AMSR) for your occupation.

Note: The AMSR must also be at least $70,000 per year. If your salary exceeds $250,000, you are exempt from this requirement.

• Conditions of employment no worse than those for Australians in similar roles.
• Be listed on the current Short-term Skilled Occupation List (STSOL).

Labour Market Testing (LMT)

The sponsor must attempt to recruit a suitably skilled Australian and provide evidence of advertising within the last four months.

Visa Applicant Requirements

As the visa applicant, you must:

• Have qualifications and/or experience that match the nominated position.
• Have at least two years of full-time experience in your occupation.
• Intend to stay temporarily and work in the nominated position.
• Meet any licensing, registration, or professional membership requirements.
• Arrange adequate health insurance and meet relevant health and character criteria.

English proficiency requirements:

• Hold a valid passport from the UK, USA, Canada, New Zealand, or Ireland OR
• Meet the required scores in IELTS, OET, TOEFL iBT, PTE, or CAE tests.
